At least, my car shop accepted no responsibility for my car getting stolen. I should've taken them to small claims court for my deductible but instead I just stopped going there completely (and we'd been going to that shop for years).
I'm glad I did get my car back, but I know damned well they left my key in the car and that's how it was stolen.
Hopefully your dad's car will be there in the morning!
If it's not, take the insurance payout even if they recover the car. I wish I had, I think I would have gotten a better payout than what I ended up getting for it when I sold it a year later.
