But it's not just about a separation or divorce. It could also be about what happens if Gisele is hit by a car in 6 years and is put on life support. If she's married, it's her current spouse who makes the call. If she's unmarried, it'll be her children serving as her next of kin.

So while technically, all of these scenarios can be reworked with living wills, pre-nups, trusts...I'm not sure what benefit she'd get out of going that route.
