The accident was 100% Jordan's fault because she took her eyes off the road and Brooklynn swerved into the guardrail to keeping it from being a more serious accident. As far as she knew, her actions kept an accident from happening since she didn't hit Jordan's car!
Brooklynn honestly didn't see their car spin out, and continuing to drive had her being responsible for the repairs instead of Jordan's insurance.
Jordan chose to take her eyes off the road to kiss Curtis and had Brooklynn not swerved, she could have been seriously injured as well.
The way they have structured this, Jordan needs to take full responsibility for this.
